Divide Boardshop Waiver

RELEASE OF LIABILITY, WAIVER OF CLAIMS. AND EXPRESS ASSUMPTION OF RISK AGREEMENT

I hereby understand and acknowledge the extreme inherent hazards and risks associated with bicycle, electric bicycle riding (“ebike activities”), ski and snowboard activities, and other rental equipment.

I understand and acknowledge that these risks could lead to severe physical and/or emotional injury, paralysis, death, and/or damage to me, property belonging to me, Divide Boardshop LLC (“DBS”), and/or to third parties. My participation in these activities is voluntary, and I agree to assume all risk of personal injury, including paralysis and death, which may occur while I am at/on any DBS’ facility or participating in any activity.

I hereby voluntarily release and hold DBS, it’s owners, members, managers, employees, volunteers, agents, lessors, insurer, and representatives harmless from all liability for all personal injury that I may incur and waive any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of DBS equipment and/or facilities, including any such claims which allege negligent acts or omissions of DBS.

I understand that this Agreement waives any and all of my claims for personal injury, including death based in total or in part upon the negligent action or inaction of DBS, it’s owners, members, managers, employees, volunteers, agents, lessors, insurer, and/or representatives.

Insurance Policy
I certify that I have adequate insurance to cover any injury or damage that I may cause or suffer while participating in any related activities, or else I agree to bear the cost of such injury or damage myself. I certify that I have no emotional and/or physical conditions that could interfere with my safety in this activity, or else I am willing to assume, and bear the cost of, all risks that may be created, directly or indirectly, by any such condition.

Helmet Policy
Helmets are strongly recommended and available at a $10/day charge. I acknowledge that if I choose not to wear a helmet, I assume all risks related to that decision.

Indemnification
I agree to indemnify and hold harmless Divide Boardshop from any third-party claims resulting from my actions while using the rental equipment.

Equipment Responsibility
I accept full financial responsibility for the e-bike and any gear rented. I will return all items in good condition and agree to pay for any damage, loss, or theft during my rental period.

Rider Requirements
I confirm I am at least 18 years old, capable of operating an e-bike, and will follow all applicable traffic laws. I will not ride under the influence of drugs or alcohol.

Legal Terms
This agreement is governed by the laws of the State of Colorado. If any part is found unenforceable, the rest remains in effect.

Consent & Acknowledgment
I have read and agree to all terms listed, and understand the risks of e-bike use and voluntarily accept them. I understand helmets are not required but strongly recommended.
